"Unless explicitly agreed otherwise in writing, the most recently filed version of the Dutch Forwarding Conditions (Nederlandse Expeditievoorwaarden) lodged by FENEX with the Clerks of the District Courts of Amsterdam (Rotterdam, Breda and Arnhem), including the arbitration clause, which we can waive, applies to all our activities. The most recently filed version of the Dutch Warehousing Conditions (Nederlandse Opslagvoorwaarden) lodged by FENEX with the Clerk of the District Court of Rotterdam, including the arbitration clause, which we can waive,  applies to all contracts that relate solely to the storage of property. Dutch law applies. Claims that Scheepvaartonderneming Euro-Rijn B.V. may bring before the court under Article 23(1) of the Dutch Forwarding Conditions and/or Article 4.1 of the Dutch Warehousing Conditions are settled exclusively by the competent Dutch court in the town or city where Scheepvaartonderneming Euro-Rijn B.V. has its official business address. The terms and conditions have been provided to you before or at the close of the agreement and will be sent to you free of charge upon request and can be read and downloaded from our website www.eurorijn.com  under the heading downloads & Links "

Euro-Rijn Deutschland GmbH

Wir arbeiten ausschliesslich aufgrund der Allgemeinen Deutschen Spediteursbedingung (ADSp), jeweils neueste Fassung. Diese beschränken in Ziffer 23 ADSp die gesetzliche Haftung für Güterschäden nach § 431 HGB für Schäden in speditionellem Gewahrsam auf 5 EUR/kg; bei multimodalen Transporten unter Einschluss einer Seebeförderung auf 2 SZR/kg sowie ferner je Schadenfall beziehungsweise -ereignis auf 1 Mio. beziehungsweise  2 Mio. EUR oder 2 SZR/kg, je nachdem, welcher Betrag höher ist.

Für Schifffahrtsgeschäfte gelten unsere c/p oder Konnossementsbedingungen sowie die der am Transport beteiligten Reedereien. Transportversicherung mangels Auftrag nicht gedeckt. Erfüllungsort und Gerichtsstand: Duisburg
